1. GENERAL PROVISIONS 

1.1. Scope 

These Terms and Conditions (“Terms”) govern the use of the website www.tuff.hr and all purchases made through the online store operated by:

1.2. Acceptance of Terms 

By accessing this website and placing an order, the user (“Customer”) confirms that they:

  • have read these Terms,
  • understand them,
  • agree to be legally bound by them. 

If you do not agree, you must not use this website. 

2. AGE REQUIREMENT AND LEGAL CAPACITY 

2.1. Legal Capacity to Contract 

This website and the services offered herein are intended only for individuals who have full legal capacity to enter into legally binding contracts under applicable law. 

By placing an order through this website, the Customer represents and warrants that: 

a) they are at least 18 years of age or the age of legal majority in their country of residence; and 
b) they possess the legal capacity to enter into binding agreements. 

If these conditions are not met, the Customer must not use this website or place an order. 

2.2. Minors 

Persons under the age of 18 may use this website only under the supervision of a parent or legal guardian. 

The Seller reserves the right to cancel any order where there is reasonable suspicion that it was placed by a minor without appropriate legal consent. 

2.3. Data Protection and GDPR Compliance 

In accordance with Article 8 of the General Data Protection Regulation (EU) 2016/679, where information society services are offered directly to a child, the processing of personal data shall be lawful only where the child is at least 16 years old, or such lower age as permitted by national law (but not below 13 years), and where appropriate consent has been given or authorised by the holder of parental responsibility. 

The Seller does not knowingly collect personal data from individuals under the applicable age threshold without verified parental consent. 

If it becomes aware that personal data of a minor has been processed without valid consent, such data will be deleted without undue delay. 

3. PRODUCTS AND BUSINESS ACTIVITY 

3.1. Product Categories 

The Seller offers:

  • Fitness equipment
  • Sports and fitness apparel
  • (In the future) Nutritional supplements 

3.2. Product Information 

We strive to ensure that product descriptions, images, and specifications are accurate. 
However, minor deviations in color, packaging, or design may occur. 

Images are illustrative and may not exactly reflect the final product. 

4. PRICES 

4.1. Currency 

All prices are displayed in EUR and include VAT where applicable. 

4.2. Price Changes 

The Seller reserves the right to change prices at any time. 
The relevant price is the one displayed at the time of order confirmation. 

4.3. Errors 

In case of obvious pricing errors, the Seller reserves the right to cancel the order. 

5. ORDER PROCESS AND CONTRACT FORMATION 

5.1. Steps 

    The customer orders the product or products via the electronic order form. A customer is considered to be any person who electronically orders at least one product, fills in the required information, and sends the order. The goods are ordered electronically by selecting a specific product and saving it to the shopping cart.

    The ordering steps include:

    1. Product selection

    2. Adding to cart

    3. Entering billing/shipping information

    4. Selecting payment method

    5. Order confirmation

    5.2. Contract Formation 

    The goods are considered ordered at the moment the customer selects and confirms the payment method. The contract is concluded when the Customer receives order confirmation via email.

    The Seller reserves the right to refuse or cancel orders in cases of:

    • suspected fraud,
    • technical error,
    • incorrect pricing,
    • stock unavailability.

    6. PAYMENT METHODS 

    Ordered products or services are paid online using one of the following credit cards: Mastercard®, Maestro®, or Visa.

    Accepted payment methods include:

    • Credit/Debit cards (Mastercard®, Maestro®, Visa) – secure online payment via Monri

    • Bank transfer

    • Other methods listed at checkout

    7. DELIVERY 

    7.1. Delivery Area and Time

    Delivery is available in Croatia. Estimated delivery time: [2–5 business days].

    7.2. Dispatch and Delivery Procedure 

    The Seller commits to send the shipment to the customer at the moment when the confirmation of the approved online transaction is received. After the courier (delivery company) receives the shipment from the Seller, the Seller is no longer responsible for the further course of delivery and possible delays or problems that may arise regarding further manipulation and delivery of goods.

    7.3. Receipt of Goods 

    Ordered products are packaged in such a way that they will not be damaged during usual manipulation. Upon taking over the shipment, the customer is obliged to check the condition of the shipment and, in case of damage, immediately report the product to the delivery courier (employee of the delivery company). The seller disclaims all responsibility regarding damages that may occur during delivery.

    7.4. Complaints regarding Defective Products 

    The Seller commits to deliver a product that is technically functional and corresponds to the product description stated on the website. In the event of a technical defect, the customer is obliged to complain about the product. The Seller is not responsible for possible damages and other obligations that are in the domain of the courier. More about it at Refund & Return policy

    8. RIGHT OF WITHDRAWAL (EU CONSUMERS) 

    8.1. 14-Day Withdrawal 

    Consumers have the right to withdraw from the contract within 14 days without giving any reason. 

    8.2. Conditions 

    Products must be: 

    • unused 
    • undamaged
    • in original packaging 

      The Customer bears the return shipping cost. 

      8.3. Refund 

      Refunds will be issued within 14 days of receiving returned goods.

      9. SPECIAL PROVISIONS FOR NUTRITIONAL SUPPLEMENTS 

      (When applicable) 

      9.1. No Medical Claims 

      Supplements are not intended to diagnose, treat, cure, or prevent any disease. 

      9.2. Usage Responsibility 

      The Customer is responsible for:

      • reading ingredients,
      • checking allergens,
      • consulting a healthcare professional if necessary. 

      The Seller shall not be liable for misuse. 

      10. INTELLECTUAL PROPERTY NOTICE 

      10.1. Ownership 

      All content on this website, including but not limited to:

      • logos
      • trademarks
      • text
      • product descriptions
      • images
      • graphics
      • website design
      • source code 

      is the exclusive property of the Seller or licensed third parties. 

      10.2. Restrictions 

      No content may be:

      • copied,
      • reproduced,
      • distributed,
      • modified,
      • republished, 

      without prior written consent. 

      Unauthorized use may result in legal action. 

      11. LIMITATION OF LIABILITY 

      11.1. General Limitation 

      To the fullest extent permitted by law, the Seller shall not be liable for:

      • indirect damages
      • consequential damages
      • loss of profit
      • loss of business
      • data loss 

      arising from the use of this website or purchased products. 

      11.2. Product Use 

      The Customer assumes full responsibility for proper use of:

      • sports equipment,
      • fitness equipment,
      • supplements. 

      The Seller is not liable for injuries resulting from improper use. 

      11.3. Maximum Liability 

      In any case, the Seller’s total liability shall not exceed the amount paid by the Customer for the specific product. 

      This limitation does not exclude liability where exclusion is prohibited by law. 

      12. DISCLAIMER 

      The website is provided “as is” and “as available.” 

      The Seller does not guarantee that:

      • the website will be uninterrupted,
      • errors will be corrected immediately,
      • it will be free from viruses or harmful components. 

      13. PRIVACY AND DATA PROTECTION 

      Personal data is processed in accordance with:

      • GDPR (EU Regulation 2016/679)
      • The Seller’s Privacy Policy 

      14. GOVERNING LAW 

      These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia and applicable EU legislation. 

      Any disputes shall fall under the exclusive jurisdiction of the competent court in Varaždin, Croatia. 

      Consumers may also use the EU Online Dispute Resolution (ODR) platform. 

      15. SEVERABILITY 

      If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

      16. MODIFICATIONS 

      The Seller reserves the right to amend these Terms at any time. 

      Changes become effective upon publication on the website.
